Ellis George LLP Attorneys Secure $34.9 Million Award in Pharmaceutical Trademark Infringement Case

Ellis George LLP Managing Partner Keith J. Wesley, Partner Chris Arledge, and Associate George Laiolo obtained a $34.9 million award last week on behalf of their pharmaceutical client in the second-largest jury verdict in the State of California this year and 14th-largest jury verdict in a trademark case in the nation over the last 25 years.

Wesley, Arledge and Laiolo represented ImprimisRX LLC, who trademarked nine distinct brand names of post-surgical eye drops. Ellis George attorneys argued that its client suffered significant damages due to trademark infringement and unfair competition under California and federal law.

A jury in San Diego unanimously agreed on all issues, granting the plaintiff $10.5 million in actual damages on seven of the trademarks, $4 million in damages on the remaining two trademarks, and $20.4 million in punitive damages.
